General Terms and Conditions

At this point, we would like to inform you about our general terms and conditions, which supplement the legal provisions of Ride & Rad, Co Ltd and, if effectively agreed, are part of the package travel contract concluded between you and us. Please take your time and read the conditions in peace. If you have any questions, we are happy to answer them.

1. Booking/payment of the travel price

1.1. Registration takes place on the basis of the service descriptions listed in the catalog or on the website. You can register for a trip in writing or online.

1.2. With the travel registration/booking, the customer offers RIDE & RAD the conclusion of the travel contract. The traveler is bound to the travel registration for 10 days. The travel contract comes with the confirmation – this does not require any specific form – of RIDE & RAD. A written copy of the booking confirmation (= invoice) will be sent on or immediately after the contract is concluded.

1.3. Upon receipt of the booking confirmation/invoice from us or at the earliest 6 months before the agreed end of the trip, a deposit of 20% per person must be paid. The rest of the payment will be made at least 20 days before the start of the trip. You will receive the detailed travel documents step by step after receipt of the remaining amount.

1.4. When making a bank transfer, the customer must ensure that bank charges are borne by the customer in the customer’s country.

1.5. When booking at least six people at the same time, we grant the RIDE & RAD group discount of 5 – 10% on the basic tour price. Group discounts also apply to bonus bike tours. Prerequisite is a joint registration and invoicing as well as payment of the total travel price in two instalments (down payment and final payment). If you pay in more than 2 instalments (excluding short-term services), the group discount will lapse.

2. Cancellation – replacement participant – rebooking

2.1. The customer can withdraw from the contract at any time before departure. The resignation has to be written. In the event of cancellation or no-show, the following cancellation fees are due from the travel price:

  • Up to the 28th day before arrival 20%, however at least USD 50 per person.
  • From the 27th day to the 14th day before arrival 30%.
  • From the 13th day to the 8th day before arrival 50%.
  • From the 7th to the 4th day before arrival 70%.
  • ‘From the 3rd day or if the trip does not start, 90%.

2.2. The customer’s change requests regarding participants, accommodation, type of catering or similar are possible up to 28 days before the start of the trip for a change fee of USD 50 per change process. A rebooking by the customer on a different trip or a different date is only possible in the form of cancellation (according to the cancellation conditions in section a) and a subsequent rebooking.

2.3. If the traveler does not take advantage of single travel service as a result of early return travel due to illness or for other reasons for which RIDE & RAD is not responsible, the traveler is not entitled to proportional reimbursement.

2.4. If an accommodation becomes a single use due to the cancellation of a travel participant, the canceling travel participant will be charged the cancellation costs (according to item 2) according to the above-mentioned cancellation rates, but at least a flat-rate compensation of USD 150. For the conversion of the booking to individual accommodation, the remaining travel participant will be charged the regular surcharge for individual accommodation. The organizer reserves the right to change the accommodation according to the occupancy.

3. Cancellation and termination by Ride & Rad

3.1. If a trip is canceled for reasons that we cannot influence (strike, natural disasters, etc.) or if the stated minimum number of participants is not reached during a trip, RIDE & RAD can withdraw from the travel contract in accordance with the following provisions.

3.2. RIDE & RAD is obliged to immediately notify the traveler of the cancellation of the trip if it is certain that the trip cannot be carried out for the reasons mentioned above.

3.3. If a trip is not carried out due to the minimum number of participants not being reached, RIDE & RAD is obliged to notify the traveler at least three weeks before the start of the trip.

3.4. Payments made will be refunded immediately. There are no further claims, in particular for reimbursement of cancellation costs for flights already booked, train tickets, overnight stays, etc. We, therefore, recommend that flight bookings etc. only be made when it is certain that the desired trip will be carried out.

4. Services and prices

4.1. RIDE & RAD’s obligation to perform arises from the content of the booking confirmation in conjunction with the catalog or travel advertisement valid for the time of the trip, in accordance with all the information and explanations contained therein, and includes individual agreements.

4.2. Follow-up transport by train/bus/plane must be organized or booked by the customer. Upon request, RIDE & RAD is ready to arrange appropriate transportation.

4.3. The decisive factor for all discounts that result from the age of the customer is the age on the day of travel.

5. Changes to contract content before the start of the trip that does not affect the travel price

5.1. Deviations of essential characteristics of travel services from the agreed content of the travel contract, which become necessary after the conclusion of the contract and which RIDE & RAD did not bring about in good faith, are permitted to RIDE & RAD before the start of the trip, insofar as the deviations are insignificant and Do not affect the overall layout of the trip. Changes include e.g. B. Rebooking to an identical ship of the shipowner, changes in travel times and/or routes for river trips, which can occur in the event of an unpredictable flood or low water (safety or weather reasons), the total or partial failure of Sections or the implementation of sections by other means of transport, the elimination or changes in excursion programs.

5.2. RIDE & RAD is obliged to inform the customer about service changes immediately, after becoming aware of the reason for the change, on a durable medium (e.g. also by email, SMS or voice message) in a clear, understandable and highlighted manner. In the event of a significant change in an essential property of a travel service or a deviation from the special requirements of the customer, which have become the content of the travel contract. If the change affects the content of the travel contract, the customer is entitled to either accept the change within a reasonable period set by RIDE & RAD at the same time as the change is notified; withdraw from the travel contract free of charge or request participation in a replacement trip, if RIDE & RAD offered such a trip. The customer has the choice of reacting to the notification from RIDE & RAD or not. If the customer reacts to RIDE & RAD, he can either agree to the contract change, request participation in a replacement trip, if one has been offered to him, or withdraw from the contract free of charge. If the customer does not respond to RIDE & RAD or does not respond within the set period, the notified change is considered accepted. RIDE & RAD will point this out to the customer in a declaration of the change in performance in accordance with Section 4.2 in a clear, understandable and highlighted manner. If the customer reacts to RIDE & RAD, he can either agree to the contract change, request participation in a replacement trip, if one has been offered to him, or withdraw from the contract free of charge. If the customer does not respond to RIDE & RAD or does not respond within the set period, the notified change is considered accepted. 5.3. Any warranty claims remain unaffected insofar as the changed services are defective. RIDE & RAD is obliged to inform the customer immediately of any deviations in performance. In the event of significant changes to the travel services from the agreed content of the travel contract before the start of the trip, the customer is entitled to withdraw from the contract. The customer must assert this withdrawal immediately after the declaration by RIDE & RAD

5.4. RIDE & RAD can increase the travel price in accordance with the following calculation if the transport costs, in particular the fuel costs, at the conclusion of the travel contract increase:

a) In the case of an increase related to the seat, RIDE & RAD can demand the increasing amount from the customer.

b) In other cases, the additional transport costs required by the carrier for each means of transport are divided by the number of seats of the agreed means of transport. RIDE & RAD can request the resulting amount for the single-seat from the customer.

5.5. If the taxes such as taxes, port or airport fees towards RIDE & RAD are increased upon conclusion of the travel contract, the travel price can be increased by the corresponding proportionate amount.

5.6. An increase is only permissible if there are more than four months between the conclusion of the contract and the agreed travel date and the circumstances leading to the increase had not occurred before the conclusion of the contract and were not foreseeable for RIDE & RAD when the contract was concluded. In the event of a subsequent change in the travel price, RIDE & RAD must inform the customer immediately. Price increases from the 20th day before the start of the trip are ineffective. In the event of price increases of more than 8%, the customer is entitled to withdraw from the travel contract without charges or to request participation in an at least equivalent trip if RIDE & RAD is able to offer such a trip from its offer at no additional cost to the customer.

5.7. RIDE & RAD is obliged to pass on price reductions to the customer if the above clauses are applied accordingly.

6. Liability and limitations of liability

6.1. RIDE & RAD is liable within the framework of the due diligence of a prudent businessman for the conscientious travel preparation, the careful selection and monitoring of the service providers as well as the correctness of the service descriptions valid for the travel time at the time of printing of our catalog.

6.2. Participation in the trips is at your own risk. Minors may only take a trip accompanied by a legal guardian.

6.3. Each participant is responsible for ensuring that they are able to cope with the health of the journey. The information on the physical requirements is given to the best of our knowledge and belief, however, without guarantee. If the travel participant is unable to cope with the physical demands of a normal journey, he or she is solely responsible for this.

6.4. Compliance with road traffic regulations is also the responsibility of the travel participant.

6.5. The conditions of carriage of the respective transport company apply to all transports (bus, ship, plane, etc.).

6.6. If it is necessary to change the travel route during the trip (e.g. due to the weather, for safety reasons, etc.), this does not entitle you to a reduction in the travel price. For nautical/technical requirements, boat trips can also be made by bus. In the case of group and boat trips, the decision to change the route rests solely with the travel companion or the captain.

6.7. Should a planned inspection not take place for a reason that we cannot influence (e.g. conversion, renovation, etc.), we cannot be held responsible for it.

6.8. Should damage occur which was caused solely by a service provider selected by us or which was not caused by us intentionally or through gross negligence, our liability – regardless of the legal reason – is limited to three times the travel price.

6.9. If your luggage is lost or damaged, we are only liable if it was caused by us and is reported to us immediately after it occurs. However, only then up to max. USD 200 per person. We accept no liability for items that are usually not carried in your luggage, for all types of payment, optical damage and damage to handles and wheels and for damage to luggage with a total weight of more than 20 kg. We recommend a travel security package for these risks.

6.10. Liability for customer-owned bicycles is excluded. If RIDE & RAD takes on the transport of customer-owned bikes, any resulting claims for damage, loss or theft are excluded, unless RIDE & RAD was responsible for intent or gross negligence.

6.11 Our liability for damage of whatever nature is limited to cases of intent and gross negligence.

7. Price adjustment

7.1. RIDE & RAD reserves the right to change the price agreed in the travel contract in the event of an increase in VAT rates, transport costs or the levy for certain services, such as port or airport fees or a change in the exchange rates applicable for the relevant trip.

7.2. In the event of a subsequent change in the travel price, RIDE & RAD must inform the traveler immediately. Price increases from the 20th day before the start of the trip are ineffective. In the event of price increases of more than 8%, the traveler is entitled to withdraw from the contract without a fee.

8. Warranty

8.1. Remedy: If the trip is not performed in accordance with the contract, the customer can request remedy. What is in accordance with the contract is determined on the one hand by the service description, but on the other hand also by the customary locality of the target country. RIDE & RAD can refuse the remedy if it requires a disproportionate effort, but is entitled to remedy the situation in the form of equivalent or higher-quality replacement services. The customer can only refuse such a replacement service for an important, objective reason. The remedy is to be addressed to us directly or to the tour guide on site. However, the tour guide is not entitled to recognize claims.

8.2. Reduction of the travel price: For the duration of a non-contractual provision of the trip until remedial action by RIDE & RAD, the customer can request a corresponding reduction in the travel price in writing after the return (reduction). The reduction does not occur if and insofar as the traveler culpably neglects to notify the deficiency in good time to the bodies mentioned in section 2.1 in order to enable them to remedy the situation.

8.3. Any claims must be made to us no later than one month after the contractual end of the trip.

9. Obligation to cooperate

9.1. If the traveler does not receive his travel documents in good time before the trip, he must notify RIDE & RAD immediately.

9.2. The traveler is obliged to do everything reasonable in the event of any performance disruptions to help remedy the disruption and to minimize or prevent any damage that may arise. In particular, the customer is obliged to report his complaints immediately to 8.1. to notify the aforementioned body. They are instructed to take remedial action if possible. If the customer culpably neglects to report a defect, the right to reduction does not arise.

10. Other

10.1. During the trip, you are liable for damage or loss of bicycles and equipment left to you.
10.2. The customer is responsible for compliance with all passport, visa, customs and health regulations.
10.3. We reserve the right to change prices and services, as well as corrections of errors and misprints.
10.4. The ineffectiveness of individual provisions of the travel contract does not result in the ineffectiveness of the entire contract.
10.5. Place of jurisdiction is the location of the organizer.
